These Terms & Conditions (“Terms”) form a binding agreement between you (“you”, “your” or “Customer”) and XRG Consulting Private Limited (“XRG”, “we”, “us” or “our”), the company that owns and operates KLYKX—an AI-powered no-code platform. These Terms govern your use of the KLYKX platform available at app.klykx.ai, the website at klykx.ai, and all associated software, tools, templates, APIs and services (together, the “Service”). References to “KLYKX” mean the product and, as the context requires, XRG as its provider. By creating an account, signing in (including via a third-party identity provider), or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Acceptance & eligibility
You must be at least 18 years old and able to form a legally binding contract to use the Service. If you use the Service on behalf of an organisation, you represent that you are authorised to bind that organisation to these Terms, and “you” refers to that organisation. You are responsible for compliance with all laws applicable to your use of the Service.
2. Accounts & authentication
To access most features you must register an account. You may register with an email and password, or sign in through a supported third-party identity provider (including Google, Microsoft, Apple, LinkedIn and GitHub). When you use a third-party provider, you authorise us to receive your basic profile information (such as your name and email address) from that provider to create and secure your account, as described in our Privacy Policy.
You are responsible for keeping your credentials confidential and for all activity under your account. You must notify us promptly at Info@klykx.ai of any unauthorised use. We are not liable for any loss arising from your failure to safeguard your credentials.
3. The Service
KLYKX is an AI-assisted, metadata-driven platform that lets you design, generate, customise and run enterprise applications—including data models, forms, views, workflows, documents, analytics and integrations—without traditional coding. We may add, modify or remove features at any time. We will use reasonable efforts to notify you of material changes that adversely affect core functionality.
4. Plans, trials & billing
- Plans. The Service is offered under free and paid subscription plans. Features, limits and pricing for each plan are described on our pricing page and may be updated from time to time.
- Fees. Paid plans are billed in advance on the cycle stated at purchase. Unless required by law, fees are non-refundable and exclude applicable taxes, which you are responsible for paying.
- Changes. We may change pricing on renewal; changes take effect at the start of your next billing cycle. Continued use after a price change constitutes acceptance.
- Non-payment. We may suspend or downgrade accounts with overdue fees after reasonable notice.
5. Acceptable use
You agree not to, and not to permit others to:
- use the Service for any unlawful, fraudulent, infringing or harmful purpose;
- upload or process content that is illegal, defamatory, or violates the rights or privacy of others;
- attempt to gain unauthorised access to, disrupt, or reverse-engineer the Service or its underlying systems;
- circumvent usage limits, security controls, or authentication mechanisms;
- transmit malware, or use the Service to send spam or unsolicited communications;
- resell, sublicense or provide the Service to third parties except as expressly permitted; or
- use the Service to build a competing product or to scrape or harvest data at scale.
We may investigate and take appropriate action, including suspending or terminating accounts, for any suspected violation.
6. Your data & content
You own your data. As between you and KLYKX, you retain all rights to the data, configurations, and applications you create or upload (“Customer Data”). You grant us a worldwide, non-exclusive licence to host, process, transmit and display Customer Data solely to provide, secure, maintain and improve the Service and as otherwise permitted in our Privacy Policy.
You are solely responsible for your Customer Data, including its accuracy, legality and your right to use it, and for obtaining any consents required from your own end users. You are responsible for maintaining your own backups where continuity is critical. We may remove content that violates these Terms.
7. Intellectual property
The Service, including the KLYKX platform, software, templates, engines, documentation, and the KLYKX name and logos, is owned by XRG Consulting Private Limited and its licensors and is protected by intellectual-property laws. Except for the rights expressly granted to you, no rights are transferred. Any feedback you provide may be used by us without restriction or obligation.
8. AI-generated output
The Service uses artificial-intelligence models (including third-party models) to help generate application configurations, content and suggestions (“Output”). AI Output may be inaccurate, incomplete or unsuitable for your purpose. You are responsible for reviewing, testing and validating all Output before relying on it, and for ensuring any application you deploy meets your legal, security and business requirements. We make no warranty that Output is correct, non-infringing or fit for any particular purpose.
9. Third-party services
The Service may integrate with or link to third-party products and services (for example identity providers, payment processors, email, maps, and AI providers). Your use of those services is governed by their own terms and privacy policies. KLYKX is not responsible for third-party services and does not endorse them.
10. Availability & beta features
We strive for high availability but do not guarantee that the Service will be uninterrupted or error-free. We may perform maintenance, and may occasionally offer “beta”, “preview” or “experimental” features that are provided “as is”, may be changed or withdrawn, and are not recommended for production-critical use.
11. Disclaimer of warranties
To the maximum extent permitted by law, the Service is provided “as is” and “as available”, without warranties of any kind, whether express, implied or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Service will meet your requirements or that defects will be corrected.
12. Limitation of liability
To the maximum extent permitted by law, XRG and its affiliates, officers, employees and suppliers will not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or relating to the Service, even if advised of the possibility of such damages. Our total aggregate liability for all claims relating to the Service will not exceed the greater of (a) the amounts you paid to us for the Service in the twelve (12) months preceding the claim, or (b) INR 10,000. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
13. Indemnification
You agree to indemnify and hold harmless XRG and its affiliates from any claims, damages, liabilities and expenses (including reasonable legal fees) arising from your Customer Data, your use of the Service, your applications, or your breach of these Terms or applicable law.
14. Term & termination
These Terms apply while you use the Service. You may stop using the Service and close your account at any time. We may suspend or terminate your access if you breach these Terms, if required by law, or to protect the Service or other users. Upon termination, your right to use the Service ceases. We may delete Customer Data after a reasonable period following termination; export your data beforehand if you wish to retain it. Sections that by their nature should survive (including ownership, disclaimers, limitation of liability, and indemnification) survive termination.
15. Governing law & disputes
These Terms are governed by the laws of India, without regard to conflict-of-laws principles. Subject to any mandatory law, the courts at Hyderabad, Telangana, India will have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Service.
16. Changes to these Terms
We may update these Terms from time to time. When we make material changes, we will update the “Last updated” date above and, where appropriate, notify you. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
